Ra Medical Systems Wins Federal Lawsuit Filed by PhotoMedex
Carlsbad, CA – July 21 – Ra Medical Systems announced today that the lawsuit filed by PhotoMedex (NASDAQ: PHMD) in U.S. District Court December 2, 2008 has been dismissed by U.S. District Judge William Hayes. The judge issued the order and judgment was entered on July 17.
The lawsuit against Ra Medical Systems sought a declaration that PhotoMedex did not act with malice in bringing the lawsuit filed in 2004 and an order restraining Ra Medical from instituting any action for malicious prosecution based on that lawsuit.
Commenting on the victory, Dean Irwin, Chief Executive of Ra Medical Systems, said, "We continue to prevail in these efforts by our competitor to use the legal system to do what they are unable to achieve in the marketplace. We believe competition benefits the consumer, and these failed legal efforts only serve to waste the court’s time."
